Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website located at proper.porn and any associated services (collectively, the “Service”), operated by Pete Kibbee (“we”, “us”, or “the Operator”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Age Restriction — Adults Only

The Service contains sexually explicit, age-restricted material intended solely for adults. By accessing the Service you represent and warrant that you are at least 18 years of age, or the age of majority in your jurisdiction if higher, and that it is legal for you to view adult content where you are located. Where the law of your jurisdiction requires verified age assurance to access adult content, you must comply with those requirements, and access is conditioned on your doing so. If you are a minor, or if adult content is unlawful in your location, you must leave immediately.

2. Nature of the Service — Search and Aggregation Only

The Service is a search and discovery portal. It indexes and links to adult video content that is hosted, stored, and served by independent third-party websites (including, without limitation, Eporner, RedTube, Pornhub, and Redgifs), primarily via their publicly available application programming interfaces (APIs).

We do not host, produce, upload, own, or control any video content. Thumbnail images may be cached or proxied solely to render search results; the underlying videos remain on and are served by the third-party source sites. We are not affiliated with, endorsed by, or acting on behalf of any source site, and we exercise no editorial control over their content.

3. Third-Party Content and Links

When you select a result, you are directed to, or content is embedded from, a third-party website governed by that site’s own terms and privacy practices. We are not responsible for the availability, legality, accuracy, or content of any third-party site, and your interactions with those sites are solely between you and them. Any complaint regarding specific video content should be directed to the source site that hosts it, as well as to us via our Copyright / Notice-and-Action procedure.

4. Acceptable Use

You agree that you will not:

• use the Service in any way that violates any applicable law or regulation;
• access, or attempt to access, the Service if you are under 18 or a minor in your jurisdiction;
• use automated means (bots, scrapers, crawlers) to access the Service in a manner that burdens or disrupts it, except for well-behaved search-engine crawlers acting in accordance with our robots directives;
• attempt to interfere with, compromise, probe, or circumvent the security or integrity of the Service;
• use the Service to seek, or attempt to locate, any content depicting minors or any other illegal content. Any such content or search intent is strictly prohibited and may be reported to the competent authorities.

5. Intellectual Property

The Service’s design, layout, branding, wordmark, and original software are owned by the Operator or its licensors and are protected by applicable intellectual-property laws. Video content, thumbnails, titles, and related metadata are the property of the respective source sites or their rights holders. Nothing in these Terms grants you any right in third-party content beyond viewing it through the source site.

6. Disclaimer of Warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that results, links, or thumbnails will be accurate, current, or available.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or relating to your use of, or inability to use, the Service or any third-party content accessed through it. Nothing in these Terms limits liability that cannot be limited under applicable German or European Union law, including liability for intent or gross negligence, or for injury to life, body, or health.

8. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, damages, liabilities, and expenses arising out of your breach of these Terms or your misuse of the Service, to the extent permitted by applicable law.

9. Changes to the Service and these Terms

We may modify, suspend, or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time; the “Last updated” date above reflects the current version. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected. The place of jurisdiction, to the extent legally permissible, shall be the courts competent for the Operator’s place of residence.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
